1. Acceptance

By using Play Spotter, you agree to these Terms of Service and our Privacy Policy.

2. Intended Use

Play Spotter is designed for adult users, including parents and caregivers. The app is not directed to children under 13. By creating an account, you confirm that you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater.

You agree to use the app lawfully, provide accurate information, and not misuse the platform. You may not create multiple accounts to circumvent restrictions or suspensions, and you may not access the app through automated means, bots, scrapers, or programmatic tools without our written permission.

3. Crowdsourced Information

Content may be user-generated, third-party supplied, publicly available, advertiser supplied, or derived from mapping/place data providers. We do not verify all listings. We make no guarantees regarding accuracy, completeness, safety, accessibility, availability, suitability, hours, pricing, amenities, or conditions. Use of information is at your own risk.

Some listings may include links to third-party websites, including business websites or external resources. We are not responsible for the content, privacy practices, accuracy, or availability of third-party websites. Links do not constitute endorsement.

4. Location Usage

By enabling location services, you consent to the use of location information for local search results, nearby recommendations, maps, app functionality, and relevant advertising. You may disable location access at any time in your device settings.

5. Advertising

Ads are paid placements or third-party advertising placements. Some content may be labeled as "Sponsored." Sponsored content does not mean that we endorse, verify, guarantee, or recommend the advertised business, product, service, offer, or claim.

Local ads require approval before being shown. Payment does not guarantee approval, placement, timing, impressions, clicks, conversions, leads, customers, revenue, or performance. We may reject, pause, remove, or modify ad availability at our discretion.

If no approved local advertisement is available for a particular placement, region, or screen, Play Spotter may display third-party fallback ads, including ads served by Google AdMob or other advertising partners. Third-party ads are governed by the applicable third-party advertising provider's policies, technologies, and privacy practices.

6. Payments

Payments are handled by third-party processors such as Stripe. We do not store your full card number or bank details. Refunds are governed by our Advertiser Agreement and refund policy. Once an advertisement has gone live, cancelling a campaign does not entitle you to a refund for time already paid for.

7. Content Standards

You may not submit false, misleading, unsafe, inappropriate, illegal, infringing, obscene, harmful, defamatory, fraudulent, deceptive, or abusive content. You may not submit content that violates another person's rights or creates a safety, privacy, legal, or platform-policy concern. We may review, reject, remove, restrict, or moderate content at our discretion.

8. Intellectual Property

The app, design, branding, software, layout, and related materials are owned by Lucht Applications LLC or its licensors.

Users retain ownership of content they submit, subject to the license granted to us. By submitting listings, edits, photos, videos, reviews, reports, comments, events, or other content, you grant Lucht Applications LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, modify formatting, crop, resize, moderate, publish, distribute, and use that content to operate, improve, promote, and protect the app.

Submitted place data, listing edits, photos, videos, and other media may remain in the app unless removed by us, removed through app functionality, or required to be removed by law or policy.

By submitting content, you represent and warrant that you own or have the necessary rights to the content and that its use does not infringe any third-party intellectual property, privacy, or other rights.

9. Copyright and DMCA

We respect intellectual property rights. If you believe that content on Play Spotter infringes your copyright, you may submit a notice to our designated copyright agent at support@play-spotter.com with the following information:

• A description of the copyrighted work you claim has been infringed
• A description of the material you claim is infringing and its location in the app
• Your contact information, including name, address, phone number, and email
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

We will respond to valid notices as required by the Digital Millennium Copyright Act (DMCA). If you believe your content was removed in error, you may submit a counter-notice to the same address.

We may terminate accounts of repeat infringers at our discretion.

10. User-Generated Content & Moderation

Users may submit content including listings, photos, reviews, reports, events, and edits to playground/place data. We reserve the right to review, moderate, remove, reject, restrict, or edit content that is inaccurate, misleading, unsafe, inappropriate, violates our standards, violates law or policy, or is reported by users.

Some features may use automated systems, including AI, for tasks such as ranking, validation, spam detection, and moderation support. Automated outputs may be imperfect and may be reviewed or overridden by humans.

11. Data Sources & Automated Systems

Some location/place data in the app is provided by Google Maps Platform services or other third-party sources. Such data may be incomplete, outdated, or inaccurate. Some app features use automated systems, including AI, to support ranking, validation, review, and moderation.

12. Service Availability and Changes

We do not guarantee uninterrupted access to the app or any specific feature. The app may be temporarily unavailable due to maintenance, updates, outages, or circumstances outside our control. We reserve the right to add, modify, suspend, or remove features or content at any time, with or without notice.

13. Account Inactivity

Accounts that have been inactive for an extended period may be subject to suspension or deletion. Where feasible, we will attempt to notify you at the email address associated with your account before taking action on an inactive account.

14. Termination

We may suspend, restrict, or terminate access for violations of these Terms, violations of law, abuse, fraud, safety concerns, misuse of the app, payment issues, account inactivity, or conduct that may harm users, advertisers, the platform, or Lucht Applications LLC.

15. Limitation of Liability & Indemnification

To the fullest extent permitted by law, Play Spotter and Lucht Applications LLC are not liable for injuries, damages, losses, disputes, inaccurate information, outdated information, unsafe conditions, unavailable locations, business practices of listed or advertised entities, third-party services, third-party ads, third-party website content, or user reliance on app content. Use of the app is at your own risk.

The user agrees to indemnify and hold Play Spotter, Lucht Applications LLC, and their officers, directors, employees, contractors, and agents harmless from any and all claims, damages, liabilities, losses, expenses, and costs, including reasonable legal and accounting fees, related to: (a) your access to or use of our services or third-party services; (b) your submitted content; (c) your violation of these Terms; (d) your violation of applicable law; or (e) your negligence or willful misconduct.

Our total liability to you for any claim arising from use of Play Spotter shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater, unless applicable law requires otherwise.

Any action, regardless of form, arising out of or relating to a dispute must be brought within one (1) year after the cause of action has accrued.

16. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Nebraska, USA. Any legal proceedings shall be filed in Douglas County, Nebraska, unless applicable law requires otherwise.
